A panel of judges at the US Nuclear Regulatory Commission (NRC) has ruled that the Department of Energy (DOE) does not have the authority to withdraw the application to build a deep geological repository for radioactive waste at Yucca Mountain in Nevada.
In a setback for the Obama administration, which had promised to close down the Yucca Mountain project, the three-member panel of administrative judges said that the DOE lacked the authority to drop the application because it would flout a law passed by Congress.
